Warranty Terms and Conditions

JWL Marketing Pty Ltd, trading as Weldclass Welding Products ("Weldclass") provide the following warranty in relation to the following Weldclass products that are purchased via Weldclass' authorised distributors/retailers.

The benefits provided to the consumer in this warranty are in addition to other rights and remedies of a consumer under the Australian Competition and Consumer Act 2010 (Australian Consumer Law) and any other laws in relation to the products to which this warranty relates. Our products and goods come with guarantees that cannot be excluded under the Australian Consumer Law. The consumer is entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage, and is also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

 

 

1. Products, Warranty Periods, Registration

  1. Warranty periods for Weldclass products are as shown in the table below.
  2. The warranty period begins on the date of purchase by the consumer as shown on the tax invoice issued by the retailer / distributor.
  3. Warranty is not transferable and only claimable by the original purchaser.
  4. Proof of purchase must be provided in the event of any warranty claim. It is the sole responsibility of the purchaser to retain proof of purchase so that it can be provided in the event of any warranty claim.
  5. Proof of purchase is defined as a copy of the original invoice or reciept made out by the distributor / retailer to the original purchaser, clearly showing the purchase date and product description. 
  6. As detailed below, Weldclass offers extended warranty period if the buyer/consumer registers their purchase. To qualify, registration must be made within 30 days of purchase via the warranty registration form.
  7. Failure to register within 30 days of purchase does not affect your rights under the Australian Consumer Law, and in this case 'Normal Warranty Period' will apply as per these terms and conditions.
  8. By registering product purchase as part of Weldclass’ leading warranty scheme, the purchaser accepts and agrees to receive periodic news/promotionional publications from Weldclass, including from our subsidiary company Surefire CNC. The recipient can opt out at any time by selecting the unsubscribe options provided.

2. Warranty Includes and Covers

  1. The Weldclass branded products listed above under section 1
  2. Manufacturing defects or defective materials that prevent the product from performing the functions for which it was designed.
  3. The replacement of parts, and/or the repair labour used, and/or a refund of the price of the product, and/or other compensation for the remainder of the warranty period, in accordance with all other terms and conditions mentioned.

 

3. Warranty Excludes / Does Not Cover

  1. Any products NOT included under section 1 above
  2. Products not branded Weldclass
  3. Products NOT purchased from authorised Weldclass distributors / retailers
  4. Products purchased on Amazon, eBay and any other non-authorised websites
  5. Products purchased outside of Australia
  6. Consumable products or components, including but not limited to any kind of; abrasive discs, wire brushes, consumable torch parts, filler metals (wires, electrodes, rods, etc), wire cables and cable fittings, anti-spatter fluids and gels, replacement cover lenses, gloves.
  7. The following products or components:  Batteries for welding helmet auto-darkening lenses, flashback arrestors, gas/oxy quick couplings
  8. Products purchased by hire companies, or used for hire purposes.
  9. Warranty claims made without proof of purchase, or warranty claims made with proof of purchase that is deemed by Weldclass Welding Products to be false, misleading, incomplete or insufficient.
  10. Defects or damage resulting from: misuse, accidents, neglect, improper maintenance, tampering, alteration/modification, use of the product contrary to the applications for which it was designed, failure to heed any of the instructions, warnings or guidelines issued with the product, or use of spare parts or accessories that are not appropriate.
  11. Damage caused by sand, water damage, rust, corrosion, metallic and abrasive particles, fire or flame, vermin and/or insect infestation, power outages or surges, or inadequate or improper voltage or current
  12. Parts that are subject to wear and tear from usage or failure caused by the untimely replacement of such parts. Examples of wear and tear include, but are not limited to; worn or damaged screw threads, worn seals and o-rings, any kind of wear to moving parts, tears in clothing or leather or fabric caused by wear fatigue and/or force, wear or degradation due to internal or external thermal exposure / heat, wear to electrical cable or cable fittings.
  13. For all types of machines and power tools, any of the following faults and malfunctions that may occur beyond/after the 'Normal Warranty Period' set out in above warranty period table (section 1) are considered normal wear and tear and are not covered under warranty, if the machine has been subject to Commercial Use (see 4.8) at any time during the period of ownership; faults and malfunctions with electronic componentry, wear to wire drive systems and motors. At Weldclass discretion, an exception to this may be made if a malfunction has been found by Weldclass to be solely caused by a manufacturing defect and not by general wear and tear, and in this case consideration will be given to factors including but not limited to; the external and internal condition of the machine and any service records.  
  14. Damage incurred in/during transport.
  15. Operator error, misunderstanding or use contrary to the intended purpose.
  16. Warranty claims made where the owner/operator of the product is not willing or not able to provide all information required by Weldclass Welding Products to process the warranty claim.
  17. Warranty claims where the serial number has been altered or removed
  18. The cost of freight, transport or travel. It is the responsibility of the purchaser to deliver the product under warranty to the nearest service agent or distributor as directed by Weldclass.
  19. Cost for repairs carried out by any party not approved by Weldclass to carry out repairs, and/or if repair authorisation has not been given by Weldclass in writing or by email.
  20. Any costs related down-time that may be related to the processing of any warranty claim.
  21. In the case of welding helmets, weld spatter marking on the auto-darkening lens (note that this is caused by the improper use of, or failure to use, or untimely replacement of protective cover lenses) 

  

4. Other

  1. Should the original unit and/or parts become obsolete or unavailable, Weldclass reserves the right, at Weldclass' discretion, to either; a) replace the product or parts with alternative / closest available equivalent product or parts, or b) refund the original purchase.
  2. Whilst Weldclass is committed to timely processing of warranty claims, Weldclass does not guarantee that any warranty claim or repair or replacement will be processed within a specific time frame. 
  3. No other warranty is expressed or implied. This warranty is exclusive and in lieu of all others, including, but not limited to any warranty of merchantability or fitness for any particular purpose. Weldclass shall not under any circumstances be liable for special, indirect or consequential damages.
  4. No employee, agent, representative, distributor or agent of Weldclass is authorised to change this warranty in any way or grant any other warranty.
  5. Notwithstanding the foregoing, in no event shall the warranty period extend more than the stated warranty period plus 12 months from the date Weldclass delivered the product to the authorised distributor.
  6. Warranty is always dated from original date of purchase - if warranty repairs are made or if warranty replacements are given this does not extend the warranty period.
  7. Any decision regarding any warranty claim is made at the sole jurisdiction of Weldclass.
  8. 'Commercial use' means that the product is or has been used by or in any business, training, education or government organisation.
  9. At Weldclass discretion, in the event of any valid warranty claim, Weldclass may give instruction for the product and/or parts to be sent to any Weldclass office or warehouse or distributor/agent location for further inspection and validation of warranty. In this event the cost of freight/transport is not covered under warranty and Weldclass reserves the right to charge for and collect payment for any such freight costs in advance.
  10. Weldclass shall not be liable for any delay in performance, for non-performance of any of its foregoing warranty obligations or for any losses caused by an event of force majeure (the occurrence of any contingency beyond the reasonable control of Weldclass) including, but not limited to, breakdown or failure of transmission of communications facilities, the suspension or termination of trading or delivery of any commodity exchange or market, the imposition of a cash settlement by an exchange, clearing organization, government agency or other entity in lieu of delivery on a commodity contract or for any other reason, the bankruptcy, insolvency or liquidation of a supply chain partner, clearing organisation, broker or bank, war (whether an actual declaration thereof is made or not), sabotage, insurrection, riot or other act of civil disobedience, act of a public enemy, failure or delay in transportation, act of any government or any agency or subdivision thereof, judicial action, labor dispute, accident, fire, explosion, flood, storm or other natural cause, a shortage of labor, fuel, raw material or machinery.
  11. These terms and conditions supersede any prior published data produced by Weldclass.
